The basis for this decision is article 128 of the Labour Law for the Private Sector issued by Law No. 23 of 1976, which was repealed by the new Labour Law No. 36 of 2012. In accordance with this decision, a worker or his relatives (in the case of death) are entitled to compensation for any work-related injury that leads to death or permanent partial or total disability. The amount of compensation is detailed in the annexed table (Art. 1). The compensation for death or permanent total disability shall amount to 75% of the worker’s wages for four years. The compensation for permanent partial disability shall be determined on the basis of the percentage of disability multiplied by the amount calculated for permanent total disability as stipulated in the previous paragraph (Art. 2). |
